Creditworthiness of private customers
AMAG Leasing AG is required to assess the customer’s creditworthiness. A vehicle may only be leased if the customer will not become over-indebted as a result of entering into the lease agreement. A lessee is considered over-indebted if they fall below the minimum subsistence level defined under debt enforcement law and are therefore no longer able to meet their existing financial obligations.
AMAG Leasing AG assesses whether your leasing request can be approved based on the monthly instalment, taking into account potential risks of payment default. For this purpose, AMAG Leasing AG carries out a provisional partial credit assessment via the ZEK (Central Office for Credit Information).
Personal customer details
AMAG Leasing AG requires all customer details to be provided in full when reviewing an application. If the information provided is incomplete, approval cannot be granted. All data, particularly the sensitive additional information provided by private individuals, is subject to data protection regulations and must not be disclosed to third parties.
Consumer Credit Act 2 (CCA2)
The revised Consumer Credit Act (CCA2) came into force on 1 January 2003. Under the CCA2, leasing for consumer goods is clearly defined as a form of consumer credit agreement. The legislation pursues two main objectives:
- Greater protection for consumers
- Ensuring a consistent legal framework throughout Switzerland for the granting of consumer credit
However, a leasing agreement only falls within the scope of the CCA2 if the following conditions are met:
- The leased item is intended for private use
- The credit amount is between CHF 500 and CHF 80,000
- In the event of early termination of the contract, the agreement provides for a retrospective increase in the leasing instalments (with the corresponding additional costs)
Note on reduced affordability
Taking out consumer credit can lead to financial difficulties if the borrower’s income and expenditure situation changes unfavourably after taking on the credit. Unexpected events such as divorce, separation, loss of employment, illness or disability may affect the borrower’s ability to meet their financial obligations.
